The requests for the prejudice presented by President Bernardo Arévalo against three alternate magistrate of the Constitutional Court (CC) were rejected by the Supreme Court of Justice (CSJ). A judicial source indicated that the decision was taken in the plenary session of March 5.

President Arévalo filed accusations against the alternate magistrates of the CC because they could commit the crime of prevaricate, allegedly hiding reports to know and resolve legal actions related to Mondal and their permanence at the head of the bank.

The case climbed to the CC after the president dismissed Mondal for considering that he did not fill the qualities for the position. However, this presented legal actions that were resolved favorably.

The above caused the dismissal ordered by Arévalo to be reversed on more than one occasion, allowing Mondal to continue in the position of president of the Bentrab Board of Directors despite the presidential decision.

In July, the Executive submitted the requests for prejudice against the alternate magistrates, but the case was known in the Plenary of the CSJ until March 5, the source said.

Mondal resignation

After a legal battle of several months, the CC ultimately resolved the amparos that kept Mondal in office and resolved not to grant him definitive protection.

Subsequently, the bank manager presented his resignation.

The Vice President of the Directive, Luis Suárez, who managed to stay several months with Mondal, despite Arévalo’s decision, was also involved in the process.

Luis Suarez was a candidate for the Vice Presidency of Guatemala in the general elections of 2023. He was running along with Manuel Conde for the Vamos Party, a group that led to power to former president Alejandro Giammattei.
