The discord between deputies of the will, opportunity and solidarity (VOS) party questions the election of the first Secretariat of the Board of Directors of the Congress, due to the tensions between the parliamentarians and the Secretary General of the Political Group for the resolutions of the Constitutional Court (CC).
Deputy Karina Paz will leave the first vice presidency of Congress. A resolution of the CC ordered that the Board of Directors must inform the plenary of its separation from the bench and, consequently, a vacancy would open in the board. Paz would remain as an independent deputy, so I could not hold a managerial position. Instead, it could assume some of the other three deputies in the block, although there are legal actions that could prevent it.
Last January, the deputies of the VOS José Chic party, Jairo Flores and Orlando Blanco presented legal actions against the general secretary of that political group, Carlos Bezares, after he notified the president of the Congress, Nery Ramos, that the parliamentarians were separated from the bench for not being affiliated.
The letter was sent after the parliamentarians of you decided to separate Karina Paz from the bench, arguing differences of criteria to work and because it participated, unilaterally, in the form that Ramos headed to integrate the Board of Directors.
Resolution
This Tuesday, April 2, the Constitutional Court (CC) redirected an amparo that the Chic, White and Flores deputies presented to achieve their affiliation to the party. The CC notes that Sala that admitted the amparo had no competence and, therefore, ordered that the file return to a court. The three congressmen say that the resolution of the CC does not leave them as independent deputies.
Deputy José Chic states that the resolution of the CC is due to a procedure error.
“It happens that the sixth room knew him, now he has to return to a court and we must wait for the entire procedure. That does not affect us in the integration of the party, we are not as independent,” he said.
On affiliations, Chic says he has affiliation. However, in the case of deputies Jairo Flores and Orlando Blanco, they are not affiliated because they had doubts about doing so or not, since they sought their re -election.
“Then they signed the affiliate leaf and delivered it to Carlos Bezares, general secretary of the VOS party, but we do not know why he did not give them to the TSE,” he said.
In his defense, Bezares says that deputies Flores and Blanco have never been affiliated with the party and that, with the actions in the CC, they wanted to “force him” to be affiliated.
Carlos Bezares claims to be prepared for all the actions that may appear against him, because, so far, they have been illegal actions.
“In Chiquimula they filed another illegal protection, because it is in a criminal court, and with which they want to remove the quality of secretary general. They directed the Supreme Electoral Court so that they can hold assemblies and exercise the function that corresponds to me by law,” he said.
Unnecessary affiliation
The political analyst Renzo Rosal argues that, in Guatemala, the electoral law and political parties do not establish that the deputies must be mandatory to a political party, and that this provision has only been a proposal when it seeks to reform the law.
“Surely several deputies are not affiliated with political parties, but it is not necessary,” he said.
“The deputies should comply with the principle of political representation, but it is not so. However, it is not an exclusion criterion of the Congress, and less than a legislative block,” he said.
