Executive’s lawyers had requested the highest judicial instance to cancel an order of a judge in lesser instance in California against the decision to end the temporary protection status (TPS) for migrants in that South American country.

The Administration had argued that the TPS for Venezuela goes against the “national interest” of the USA and that justice does not have the power to decide “urgent” immigration policy.

The litigation of the case is expected to continue in lower cuts.

The TPS is a migratory program managed by the Department of National Security (DHS), that protects from deportation and gives work permits to people from countries that are going through serious humanitarian situations or natural disasters.

Shortly after assuming power on January 20, the Trump government decided to end the TPS for Venezuelans and the Secretary of National Security, Kristi Noem, described the beneficiaries of this program as “unfortunate” and criminals.

At the end of March, a federal judge in California decided to block the attempt of the Executive to end the TPS, claiming that the decision causes “irreparable damage” to those who have received such protection and their families.

Under the administration of the Democrat Joe Biden (2021-2025), the DHS decided to extend this benefit to the arguing Venezuelans that Venezuela was going through a “humanitarian emergency” caused by a political and economic crisis.

As the newspaper The Washington Post recalls, the Republican Executive stopped that extension in February before it entered into force. Without it, these protections were going to end for some migrants in April and for others in September.

The White House has left the TPS granted to other nationalities such as Salvadorans, which protects about 200 thousand immigrants since 2001. EFE
