The initial verdict of the National Superintendence of Health (Susalud) emphasizes that the clinic located in Lima, Peru, incurred a serious offense when disseminating clinical data from Colombian artist Shakira Mebarak during her stay last February. Given this, the clinic declared that the fine corresponds to an administrative resolution of first instance that will seek to appeal.
The fine filed by its health amounted to 668 thousand 750 soles (equivalent to US $ 188,000), as a sanction for having disclosed information about the singer’s state of health.
This action was indicated by its health as a lack of medical ethics and the privacy of the patient, principles that must be respected regardless of nationality, the place of care or the public relevance of the person.
Shakira’s entry into the private clinic was recorded on February 16, when the artist expressed abdominal discomfort, which led her to suspend her first concert in that city. Subsequently, he leaked from the hospital that the singer suffered gastritis and that she underwent an endoscopy, according to the media Peru21.
During this process, it is indicated that medical personnel of the clinic would have leaked clinical reports of the artist, which motivated the institution to issue an internal statement in which it reminded its employees the commitment to confidentiality.
“We remind you that the medical service provided and the coach’s interaction information (doctor) with information sources (Xhis – medical records, among others) must maintain the character of confidentiality,” revealed the media EUROPE FM.
From that moment on, the Ministry of Justice and Human Rights (Minjus) and Susalud initiated an investigation for filtration, considering that it violates Law No. 29733 on the protection of personal data in Peru.
Finally, on July 2, Susalud imposed a fine equivalent to 125 Tax Tax Units (ITU), that is, more than 668 thousand 750 soles, for violating the Personal Data Protection Law, the Political Constitution of Peru and the General Health Law.
Clinic is pronounced
For its part, the clinic spoke before the sanction and reiterated that it corresponds to an administrative resolution of the first instance, which must still be reviewed. They indicated that they will present the corresponding challenge so that the case is evaluated by the Court of Susalud.
In its statement, the institution highlighted its respect for the regulations and reiterated its commitment to medical-patient ethics, especially in the management of personal data.
The text added that the case is under review, so the resolution is not yet definitive. In case of being ratified, they will present an appeal within 15 business days, so that the Court evaluates the arguments that support its position, as reported Infobae.
Finally, the clinic reiterated its commitment to proceed with transparency, responsibility and strict compliance with the current regulatory provisions.
