Court admits Samuel Pérez’s lawsuit against prosecutor in the “Takeover of the USAC” case after CSJ ruling

A Coercive Civil and Economic Court of First Instance of Sacatepéquez admitted to processing the claim filed by the deputy Samuel Perezfrom the block Rootsagainst the prosecutor who led the investigation into the “Takeover of the USAC: Political Loot” case, after the Supreme Court of Justice (CSJ) reject pretrial requests against him.

The court document, dated March 13, 2026 in Antigua Guatemalaconfirms that the action was admitted in summary judgmentwhich implies a more agile procedure within the Guatemalan judicial system.

According to the resolution, the court:

  • He ordered a file to be formed with the documentation presented.
  • He acknowledged the legal representation of the plaintiff.
  • He gave a period of three days to the defendant to respond or present objections.

In addition, it is noted that, if you do not respond within the established period, the process will continue in rebellionwhich could affect the defense of the designated prosecutor.

The origin of the conflict: rejected preliminary trials

The demand arises after the CSJ will reject pretrial requests that they intended to link Deputy Pérez with the closure of the University of San Carlos of Guatemala (USAC).

After that ruling, the legislator maintains that the process against him was part of a criminalization strategypointing out that the investigation promoted by the Public Ministry lacked foundation.

On social networks, Pérez indicated that the admission of the lawsuit represents a step for justice to reach those who, according to him, “They have used their positions to persecute innocent people”.

The role of the prosecutor in the “USAC Takeover” case

The defendant prosecutor, previously identified as Saul Sanchezwas in charge of the investigation that accused politicians and students of using the university takeover for electoral purposes in favor of the Semilla Movement party in 2023.

That case, called “Takeover of the USAC: Political Loot”generated controversy due to its political impact and for involving key actors on the national stage.

Now, the legal action promoted by Pérez puts the actions of the Public Ministry at the center of the debate and opens a new judicial front.

Context: crisis in the USAC and legal disputes

The demand is framed in a context of high conflict in the USACespecially after the re-election of Walter Mazariegos as rector for the period 2026-2030, a process questioned by university and political sectors.

Protests, allegations of fraud and multiple legal actions have taken the conflict to instances such as the Constitutional Court (CC)where litigation is expected to continue.

Samuel Pérez himself has been one of the critical voices of the process, describing it as “illegitimate” and promoting legal actions to reverse it.
