After the blocking of 13 websites and internet television services (IPTV) accused of retransmitting protected content without authorization, the Public Ministry (MP) reported that the new Monitoring Unit will strengthen investigations related to possible violations of intellectual property rights.

The unit began to operate within the MP’s Office of Crimes against Intellectual Property and will have the function of monitoring, analyzing and documenting digital information that can serve as technical evidence in criminal investigations.

As the MP explained to Free pressthe tool will allow monitoring websites, social networks, digital platforms and cable television systems to detect possible illegal retransmissions of protected content.

However, the institution avoided providing details about its operational capacity. Asked about how web pages are crawled, how many sites they can monitor in an hour or how many they can crawl during a day, the MP indicated that this information is part of the research methodologies and technical capabilities.

“As these involve methodologies, technical capabilities and investigation procedures, it is not possible to provide information about the procedures, since this could compromise the effectiveness of present and future investigations,” the entity responded.

MP receives three complaints

The MP reported that, to date, it has received three complaints related to possible violations of intellectual property rights.

He added that, after receiving each complaint, procedures are carried out to determine the existence of the reported events and the possible responsibility of the people involved.

The MP pointed out that there is no special instruction for the prosecution of these cases, but that the actions are carried out in accordance with current legislation.

“When there is knowledge of possible facts constituting a crime related to intellectual property, the corresponding investigations are initiated in accordance with the provisions of article 274 of the Penal Code and other applicable regulations,” he commented.

Lock verification

The Prosecutor’s Office also explained how it verifies compliance with court orders blocking transmissions.

“The different distributors or providers of internet services are required to report on the result of the actions carried out in compliance with the resolution issued by the jurisdictional body. This information allows verification of compliance with the ordered measures,” he added.

As a result of the procedures carried out and the judicial resolutions issued, the MP reported the blocking of 13 sites linked to unauthorized broadcasts.

The blockages were announced after the MP and the Association of Programmers, Distributors and Agents of Cable Television Channels for Central America (APRODICA) inaugurated a specialized Monitoring Center against audiovisual piracy.
