Sierra recalled that Jorge “N” had initially been linked to the process for culpable injuries against Kevin Alexander Jimenez Ambrocioand for very serious injuries and attempted homicide to the detriment of Bautista Garcia. However, with the death of the victim, the institution will seek to have the crime reclassified as homicide.

“This implies that, obviously, the penalty increases. Simple homicide contemplates a sentence of 15 to 40 years in prison, while the degree of attempted homicide has a reduction of one third”he pointed out.

However, he clarified that it will be the judge who determines whether the requested modification is appropriate.

The Institute indicated that, until now, the process has followed its normal course and that the deadlines set by the court are maintained. The Public Ministry has until August 28, 2026 to present the conclusions of its investigation and the intermediate hearing, in which it must present them before the judge, is scheduled for September 11.

The lawyer added that it will be up to the Public Ministry to assess the circumstances of the event and the possible aggravating factors when formulating the accusation. “What the Institute hopes is to achieve a conviction and, likewise, dignified reparation for the victim,” he stated.

Likewise, he called on the population to stop spreading the videos of the accident that were widely circulated on social networks. “This greatly affects the collateral victims… the deceased has two minor children who at some point can access those images,” he warned.

The representative of the Institute pointed out that this case went beyond the judicial sphere due to the impact it generated on the population. “This case went viral on social networks and caused a lot of trauma in Guatemalan society, even internationally,” he stated.

He added that this wide dissemination and the circumstances in which the event occurred are aspects that the Public Ministry must assess within the investigation and at the time of presenting its conclusive act.

During Nidia Renata’s wake, her boyfriend, Kevin Alexander, reiterated the call for the case not to go unpunished. “The only thing we want is justice, for everything to really turn out in our favor, because that is what we want most: justice,” he said.

He also recalled that they both had plans to start a home and buy a house. “That dream is cut short for me and for her,” he lamented.
