During the session this Monday, July 27, the members of the Board of Directors of the Superintendence of Competition accepted the resignation of Superintendent Jorge Miguel Castillo Castro, who had made his position available.

In his place he was appointed Tomás Xoyóm Acán, who remained as acting superintendent of the institution.

The acceptance of Castillo Castro’s resignation letter was approved by two votes in favor and one against. Directors Javier Bauer Herbruger and Jorge Mario González Paz voted in favor, while director Édgar Guzmán voted against.

In the session of October 13, 2025, Castillo Castro was elected and sworn in as the first Superintendent of Competition.

Director Bauer Herbruger stated to Free press that the board of directors agreed by majority to accept the irrevocable resignation of Superintendent Castillo by virtue of the fact that there is no longer an administrative vacuum in legal representation, therefore, last Thursday it appointed a mayor of administrative and financial management who will temporarily exercise the legal representation of the superintendency, and is pending a decision on what the process of appointing the new superintendent will be.

“As it is an irrevocable resignation, we are only waiting for there to be a legal representative to whom legal representation can be given. The law establishes that in the temporary absence of a superintendent, legal representation can be exercised, therefore, the resignation can now be accepted,” said Bauer.

Superintendent’s resignation accepted

The Superintendent of Competition, Jorge Miguel Castillo Castro, presented his irrevocable resignation from the position for personal reasons, the Board of Directors of the Superintendence of Competition reported in a statement issued on March 10.

The president of the Board of Directors of the Superintendency of Competition (Sicom), Javier Bauer, declared that the official decided to leave the position for personal reasons.

Additionally, he indicated that the Board of Directors was scheduled to meet on March 11 to discuss the process by which the new superintendent would be chosen.

However, since then, several legal actions were filed related to the selection process for the new superintendent, which are still pending resolution.

Bauer commented that a pending appeal for reconsideration is about to be resolved in order to move forward with that discussion, and they hope that it will be resolved soon and the way to appoint the new Superintendent of Competition can be determined.
