The Constitutional Court (CC) reported on Tuesday, May 20, that the decision of the Government of Bernardo Arévalo is suspended to raise the reservation to article 27 of the Vienna Convention.
The Court accumulated the amparos received and, unanimously, resolved provisionally on this issue.
Foreign Minister Carlos Ramiro, in statements to the press, indicated that he just learned about the amparo, which they will review to know in what terms it was already granted who covered.
He said that the CC failure must comply with and hope that it will ultimately resolve in the next few days.
The Foreign Minister said they followed the procedure of law and acted based on the norm. Now they expect the final resolution, they will not make the attempt to look for another way.
He added that, together with the lawyers of the Foreign Ministry, they will evaluate the amparo to determine if any notice corresponds to the United Nations.
He indicated that the reservation was not an open door to many of the speculation and misinformation spread on social networks.
When he was consulted on the effects of the suspension, the official replied: “We returned to the previous moment, where the reservation was in force and in practice it did not apply, because it has been part of the explanations we have given. The same CC, in 25 years, has taken resolutions or issued sentences where the reserve to article 27 has set aside.”
On May 13, the Ministry of Foreign Affairs (MINEX) clarified that the Vienna Convention is applied only between States and that the Government has not signed any instrument with other countries related to abortion or equal marriage.
The MINEX said that this decision – the lifting of the reserve – has as its main purpose to give legal certainty and reaffirm the sovereignty and supremacy of the Constitution, in compliance with article 149 of the same.
Likewise, this uprising guarantees legal certainty to individual states and investors that could have uncertainty about investing in the country due to said reserve, he added.
“It does not represent, in any way, that the sovereignty of the country has been betrayed or sold, since the Constitution of the Republic remains the supreme norm of the Nation. Likewise, the Vienna Convention protects the supremacy of the Constitution, in accordance with article 46 of the same, which indicates that a treaty does not enter into force if the Magna Carta of that country violates,” said the Minex in that opportunity.
