The Attorney General’s Office (PGN) reported in a statement this Wednesday, June 4 that the Union of Education Workers of Guatemala (Steg) has to depose the de facto measures on the suspension of classes in public educational centers.
According to the PGN, it was notified of the provisional amparo granted against the National Executive Committee of the STEG, led by Joviel Acevedo.
In the amparo they are ordered “that they depose the measures of fact by the improper suspension of classes in public educational centers and were ordered to render a report within a period not exceeding 24 hours on compliance with the ordered, otherwise the leaders will be certified before the Public Ministry”, in accordance with the PGN.
The attorney general of the Nation, Julio Saavedra, indicated that the amparo orders them to depose “immediately the measures because they are illegal.”
He added that Steg is obliged to respect the right to childhood education.
He added that the sectional and subsectional leaders must depose the de facto measures to summon the teaching at the National Scale to be declared in a permanent assembly since May 19.
He explained that in the protection of freedom of association “it is left safe” the relative to the ordinary and extraordinary assemblies in accordance with the law.
He explained that, as resolved, STEG leaders cannot be in fact measures and declare in permanent assembly.
The official indicated that, if the union does not comply with, what proceeds first is to ask the Amparo Court to certify the leadership before the MP for the breach of the court order. The second would be to ask the Court to take the measures to carry out the Execution of the Amparo.
He explained that a judge when he heard from the amparo by threat – permanent association – that he had filed decided to suspend it and argued that the denounced fact had already been completed.
The attorney said they appealed the judge’s decision and then raised a new amparo because the threat was completed.
The Ministry of Education (MINEDUC) reported that, at the request of the PGN, a court granted a provisional protection against the National Executive Committee of the STEG and orders him to cease the de facto measures that violate the right to education of thousands of students.
“All the teaching must return to the classrooms without delay; the permanent protests and assemblies in school against the law,” according to MINEDUC.
The MINEDUC continues with the process of documentation and sanction of unjustified absences.
Steg trade unionists continue in permanent assemblies in the departments and maintain camp in the Plaza de la Constitución, in front of the National Palace, as a measure to press the MINEDUC.
In that place, unionized teachers spend the night and ask that the MINEDUC authorities meet their demands, including the salary increase of 15%.
This is the new strategy that trade unionists adopted to press the Government, They argue that the 5% authorized increase for the guild is not enough. In addition, they point out that it was negotiated outside the collective pact of working conditions of the teaching.
