According to the MP, the Judgment issued by the Fourth Court Pluripersonal of first criminal instance, narcoactivity and crimes against the environment of Guatemala benefits the doctor, who performed an aesthetic procedure to Roque in his clinic.

According to the MP, the probative elements collected during the investigation justify the original qualification requested by the Prosecutor’s Office.
The investigating entity recalled that it filed an amparo action for the change of crime, which is pending resolution by the First Chamber of the Court of Appeals of the Criminal Branch.
“At the Audience of acceptance of positions held yesterday, the judge was informed about this constitutional action pending to be resolved. The Prosecutor’s Office against the crime of femicide opposed the change in legal qualification and the application of the special procedure for acceptance of charges. The requested conviction
During the hearing, the prosecution against the crime of femicide requested the maximum penalty for the crime of guilty homicide.
For Kevin Malouf Sierrarequested 5 years in prison, disqualification to exercise the profession of doctor and public jobs, and the suspension of their civil and political rights for 10 years.
For Lydia Viviana Silvia Moreira, he requested 3 years and 4 months in prison for homicide in the degree of complicity, with the same disqualifications.
Also, for Susana Rojas, he requested 3 years in prison for her own cover -up and disqualification for 6 years and 7 months to exercise the nurse’s profession and be hired by the State, in addition to the suspension of her civic and political rights.
The MP concluded: “Currently, the actions to be followed within the process are analyzed, as well as the timely resolution of the pending protection.”

The sentence issued
However, Kevin Malouf He received a sentence of 3 years and 4 months in prison, Lydia Silva obtained 2 years and 3 months and Susana Rojas received 3 years.
The three defendants are disabled to exercise their position for 7 years and 7 months.
