A federal judge held a hearing to clarify whether the US administration deliberately ignored his orders by expelling more than 200 migrants to El Salvador, a country he has paid to imprison the deportees.
The lawyers of the Department of Justice told Judge James Boasberg that the deportees had already left the United States when he issued in writing the order that prohibited him, according to US media. They also argued that the magistrate lacks jurisdiction once the airplanes have left the American airspace.
The Department of Justice tried to cancel the hearing, arguing that the case interferes with “the president’s authority in the field of national security and foreign affairs.” When Boasberg said he would continue, the government’s lawyers presented a motion before an appeals court to try to make the judge away from the case.
Boasberg described the audience as an exercise of “fact investigation” and said it does not expect to issue an immediate failure.
White House spokeswoman, Karoline Leavitt, told journalists that the use of foreign enemies law, dating from the 18th century, is justified because Trump has declared the Aragua train as a global terrorist organization.
Of the more than 200 migrants expelled in the operation, 137 “were deported under the Law of Foreign Enemies”, 101 were Venezuelans removed by virtue of a migratory norm and 23 were members of the MS-13 gang, Leavitt explained.
In statements a Fox News Radiothe head of diplomacy, Marco Rubio, said that all migrants sent to El Salvador are “MS-13 MS-13 sought in their country of origin or Venezuelans that are part of the Aragua train.
“To begin with, they were not supposed to be in our country,” he said.
“I would say that each of the people who were in that plane was in the country illegally, in one way or another,” he added.
The foreign enemies law has only been invoked during the War of 1812, World War I and World War II.
Human Rights Defense Groups are used as an excuse for mass deportations without due process.
The president of El Salvador, Nayib Bukele, wrote on his social networks: “UPS … too late”, accompanied by an emoji of a face crying with laughter and the judge’s announcement.
Venezuela condemned him sharply.
“What is being committed against Venezuelans kidnapped in El Salvador and against Venezuelan migrants in the United States is a crime against humanity and we will report it in all instances,” said Jorge Rodríguez, president of Parliament and negotiator head with Washington.
“It is not worth the alleged American dream into Salvadoran nightmare, because it is a vulgar kidnapping what is happening,” he added.
Indults “Null”
For now, Trump claimed to have annulled the pardons issued by Joe Biden.
In a message on your network Social truththe Republican tycoon said that the preventive pardons granted by Biden to several staunch enemies of the Republicans were “null and without effect” because they signed with a Self And not by hand.
He Self It is a machine that is used to sign documents automatically from a real firm. There are different models, but these machines usually include mechanical arms that support the pen to sign as the person would.
It is not clear what authority has Trump, if he has any, to cancel the presidential pardons issued by his predecessor.
Hours before delivering power on January 20, Biden granted a series of preventive pardons to officials and former high positions to protect them from “unjustified prosecutions and political motivations.”
Among them are the former Chief of the Joint General Staff, Mark Milley; The exarcite of the White House strategy against COVID-19, Dr. Anthony Fauci, and several congressmen who participated in the Capitol Research Commission on January 6, 2021.
