In two days, the new authorities of the Bar Association and Notaries of Guatemala (CANG) must take possession, but the current Board of Directors of Mario Siekavizza has not yet given details to the winners about the process of taking possession.
The protocol acts for the assumption of the Board of Directors and the Court of Honor for the period 2025-2027 are not the only thing that clouds the transition. An apparent consultation promoted by Siekavizza, seeking not to leave office, has also echoed since last weekend.
Although the information has not been confirmed or discarded by any authority of the Professional College, its apparent justification would be supported in an appeal against voting that has not been resolved.
The lawyer and former candidate for the Court of Honor, Diego Sagastume Vidaurre, appealed aspects of the CANG elections, including the call for an apparent error on the dates and possible inconsistencies in the results of three tables of the capital city.
That resource, which seeks to cancel the elections of the Bar Association, was processed by the Assembly of Presidents of the Professional Colleges, which since last Friday has a new board of directors and has kept silent around the issue.
The weekend information began to circulate information on an apparent response from the Assembly to the Siekavizza directive, where they would have concluded that the appeal prevented the taking of possession of the elect until it is resolved.
It was called and wrote to a cell phone number associated with Siekavizza, but did not respond to communication.
Respect vote
The form 4 won the CANG Court of Honor, headed by the former Alicia Franco, a group that is linked to the former USAC former, Estuardo Gálvez.
Form 10 obtained the Board of Directors, led by the former Patricia Gámez. This form is linked to the seed government.
Berner García Mozote, Form 4 prosecutor, said he has also heard rumors about the apparent consultation, but at the moment he ensures that what the current authorities should do is respect the results.
“In the end, they are rumors and, until we have no official resolutions, we know we have to assume,” he said.
Gregorio Saavedra, prosecutor of Form 10, said they have a week without news from CANG about the inauguration.
“That apparent consultation would not be a competence of the Assembly.
Struggle for prosecutor
For Marco Antonio Sagastume, former president of the CANG, the obstacles to the inauguration are due to the positions that Franco and Gámez will have in the future application commission for attorney general. Both, for the charges won, will have a voice and vote in the next commission.
“I would like schools to be on the right side, what we should do is not very big.
But the appeal that is in process, at Sagastume’s discretion, could only mean time, because it considers that the background intention of some groups is to cancel the process and repeat the votes.
“We want to delay possession, but what they want is to cancel the choice.
In May of next year, María Consuelo Porras leaves the Public Ministry (MP) and the elected authorities will have a voice and vote in the election of future candidates for office.
Does not stop renewal
Ovidio Orellana, former president of CANG, points out that the appeal has no suspensive effects, but highlights that the current CANG must be more transparent.
“It only remains in unofficial information that, in the end, could have some kind of affectation, possibly arbitrary, in the change of command in school.
Orellana stressed that, until now, there is no action that prevents the renovation of CANG for next March 20, highlighting that Franco and Gámez must assume the charges.
“No appeal in relation to the appellate acts of the College has suspensive effects, therefore, there should be no legal reason that prevents the inauguration of the elected Board of Directors, unless there is some provisional protection that so provides, which, to the present date, I understand, it does not exist.”
