The V member magistrate of the Supreme Court of Justice (CSJ), Estuardo Cárdenas, seeks the intervention of the Constitutional Court to annul his transfer from the criminal chamber, which concentrated control over the protections and preliminary proceedings that reach the Judiciary in the group related to President Claudia Paredes.
Cárdenas presented an amparo in the Constitutional Court (CC) considering that his transfer was “arbitrary” and with which he seeks to reverse the change, which in his opinion has no justification.
The magistrate was a member of the Amparo and Pretrial Chamber, and in the discussions he represented the only voice of opposition that, according to sources, recommended protections in favor of the freedom of journalist José Rubén Zamora, founder of elPeriódico.
During a plenary session on April 29, with ten out of 13 votes in favor, the CSJ decided to remove Cárdenas from the criminal chamber and ordered him to join the Civil Chamber without any justification, says a source who prefers not to be cited.
Those who voted in favor of this transfer are: Claudia Paredes, president of the CSJ; Luis Corado; René Girón; Gustavo Morales; Jenny Alvarado Teni; Teodulo Cifuentes; Flor García; Clemen Juárez; Carlos Contreras and Igmaín Galicia.
The votes against are from Carlos Rodimiro Lucero Paz, who according to sources is no longer an opposition actor; Flor by María Gálvez; and Cárdenas himself who stated that he did not agree with his transfer.
With that decision, the new Chamber of Amparos was chaired by Clemen Juárez; along with members Lucero Paz, who has a pending pretrial process for a labor case; Contreras; and Galicia.
unscheduled CC
The protection, according to the documents, was presented to the CC on May 29 at 5:41 p.m., but until this moment the file has not been discussed for a possible provisional protection.
This action is located in the highest Court under registration number 4787-2026, which at noon on July 2, does not appear in the agenda proposals for next week that the CC has already uploaded on its website.
The protection, despite having more than 30 days since its presentation, has not been scheduled by the magistrate Annabella Morfín, president of the Court and who has control of the agendas known to the plenary session.
