The Constitutional Court (CC) granted on Monday, May 5, a provisional protection to opposition deputies and ordered the Congress of the Republic to resume the plenary session that was suspended last April 29 by the president of the Legislative, Nery Ramos, who alleged lack of guarantees to continue due to several incidents in the hemicycle.
That day, Ramos informed in a press conference that, due to the lack of conditions in the hemicycle, he decided to suspend the plenary session, in which, among other issues, the repeal of the agreement of the salary increase that the deputies were approved at the end of last year would be discussed.
The session was marked by several incidents between deputies, which even reached the blows, As was the case with the Parliamentarians of León and Elena Motta. Therefore, the plenary was closed by Ramos, who justified his decision based on the lack of conditions, since, in his opinion, there are parliamentary blocks that want to “assault” the legislative board of directors.
Given this, deputies Álvaro Enrique Arzú Escobar, Elmer Josué Palencia Reyes, Felipe Alejos Lorenzana, Nadia Lorena de León Torres, Carlos Enrique López Girón, Rodrigo Antonio Pellecer Rodríguez, Allan Estuardo Rodríguez Reyes and José Inés Castillo Martínez filed an amparo before the CC against the president of Congress, Nery Ramos.
This Monday, the CC decided to declare with place the appeal filed by the opposition and ordered the Congress to resume the session mentioned on Tuesday, May 6 at 2:00 p.m. This must be resumed at the point where the quorum was verified and will continue with the motion that corresponded, presented by the deputy Elmer Josué Palencia Reyes.
In the resolution, the CC details that Ramos did not send the circumstantial report that was requested, so the protection was declared.
“The reproached authority is ordered, that in the exercise of its powers, as regulated by article 18 of the Organic Law of the Legislative Agency, it summons the deputies to the Congress of the Republic to the resumption of the tenth ninth additional ordinary session of that state agency, which must be carried out on Tuesday, May six of this year, at fourteen hours, the same time must be resumed at the point where the procedure must Quorum verification, on April twenty -nine, two thousand and twenty -one; Motion to continue with the development of the agenda, ”says the CC in its resolution.
In addition, he says that “the deputies to the Congress of the Republic must be informed of said call for resumption of ordinary session, within two hours following that the reproached authority is notified this resolution, and for the verification of the quorum must act in accordance with article 69 of the law of the legislative body, proceeding electronically or by manual count if necessary, giving the prudential time to guarantee the participation of the participation of the participation. parliamentarians in the aforementioned session, privileging the primacy of reality in terms of this extreme. ”
