Although the protesters were evicted, they reorganized a street below. Men armed with sticks, some with bates and other objectsthey tried to repel the gases.

Who are the detainees and what they are accused of?

The PNC and the Public Ministry (MP) reported that the investigations continue and ruled out that the two detainees are responsible for having rammed the agents.

The detainees were identified as Brayan Josué Lobos Tocorá and Selvin Humberto Ixbalán Coyoywho were transferred to the Tower of Courts on Wednesday, March 19.

The Prosecutor’s Office confirmed that the fixation of the hearing is still pending to publicize the reasons for his arrest. In both cases, they are accused of the crime of attack.

“They were arrested for having launched objects to the Elements of the PNC, specifically pieces of Bloc and a metal tube,” the MP reported according to the police report.

Legal implications

The crime of attack is regulated in article 408 of the Criminal Code, which establishes the actions that constitute this crime. This article is included in the chapter of crimes against public administration and describes that the crime is committed:

  1. For those who, without rising publicly, use violence for any of the aims indicated in the crimes of rebellion or sedition.
  2. For those who undertake an official, the authority or their agents, or use violence against them when they are in the exercise of their functions or positions, or on the occasion or reason of them.

Regarding the penalty, it is established that those responsible for the attack will be sanctioned with imprisonment of one to three years.

Previous case

In July 2021, a man was sentenced to two years in prison for the crime of attack after participating in a protest in November 2020. On that occasion, he was involved in the fire of a collective bus of the Transurban Line and in an attack against a PNC officer.

In addition, fire crime was charged, so a six -year prison sentence was imposed.
