In 2014, Roberto Gordillo Coronado, aka Minga, was sentenced to 40 years in prison for the death of two people and cause wounds to three in Izabal. After purging 11 years in prison, a judge ordered that he be allowed to leave prison with an electronic telematic control bracelet.
Gordillo was imprisoned in the Izabal prison, but in November 2024 he was transferred to the renewal prison 1, because he was allegedly linked to an illegal charges to others deprived of liberty, known as Talacha.
According to authorities of the Telematic Control Unit of the Ministry of the Interior (Mingob) 186 electronic bracelets have been installed to people in preventive detention, and one more to a homicide convicted.
“This has been the only case and is due to the resolution of a judge. There are 187 people who are currently benefiting from the device; only one of them meets a condemnation for homicide, the rest are subjects that are still pending to conclude their criminal process,” added authorities of that agency.
On December 8, 2014, the Public Ministry reported that Roberto Gordillo Coronado, aka Minga, was sentenced to 40 years in prison for the crimes of homicide and homicide in a tentative degree.
Eleven years later, on April 11, the Pluripersonal Court of Criminal Execution of Chiquimula ordered the Ministry of the Interior (Mingob) to place a telematic control device so that it can leave the prison and can mobilize in Puerto Barrios, Izabal, Zacapa, Chiquimula and Guatemala, as detailed by the resolution.
The court order details that the expenses for the use of the device will be borne by the Mingob for the next 29 years, a deadline issued by the Court.
Condemn against Gordillo
In December 2024, MP published that the Izabal District Prosecutor’s Office managed to convince the Criminal Judgment of Crimes of Femicide and other forms of violence against women that Roberto Gordillo Coronado was responsible for the crimes of double homicide and homicide in the degree of attempt.
“Gordillo Coronado was sentenced to 40 years in prison unmutable; for each of the homicides the court gave him 15 years, and 10 for the three homicides in the degree of attempt,” said the MP on that occasion.
He added that the file states that on July 9, 2008, in the 14th street between 15 and 16 Avenida de Puerto Barrios, Izabal, Gordillo was responsible for shot Fulvia Nataly Nolasco González and Jorge Pablo González, who died, and three other people who were injured.
He commented that the mobile investigated by prosecutors is related to an incident that occurred that night inside a dance. Upon leaving, the victims were followed by Gordillo, who attacked them in a lonely sector.
Analysts warn that a precedent could be marked
According to the lawyer Francisco Cortez, the Chiquimula Execution Judge committed the crime of prevaricate and the MP must act ex officio to initiate a process of prejudice against the Togado.
“In accordance with articles 73 and 79, which were reformed in the Criminal Code through the Telematic Control Law, this benefit could not have been granted to the person,” he said.
Article 73 establishes that the benefit of probation to persons convicted of serious crimes, as homicide, will not be granted.
He added that it could not have been ordered to place telematic control to the inmate, although in the future it was undergoing the redemption of the penalty and obtaining an early freedom.
The inmate, cataloged as high danger by the Ministry of the Interior, could represent a danger to citizens when they are released, according to the expert.
In addition, he emphasized that these types of resolutions could mark a precedent for others to convicted for malicious crimes request the benefit of telematic control.
“It could mark a precedent, but the judges who grant it have to be known that there is the crime of prevaricate, and the MP, ex officio, must initiate an prejudice against that execution judge that issued this aberrant resolution already clearly illegal,” he emphasized.
Cortez described the judge’s resolution as a mockery, not only for the justice system, but also for the families of the victims.
The Doctor of Criminology and Independent Analyst Federico Reyes said that the judgment for homicide is final and qualified as suspicious the resolution of the judge, since Gordillo will spend the 29 years that remain as a condemnation.
“That leaves the judicial agency in question. It would be necessary to see what the position of the MP is, because they are the ones who have to appeal a decision,” he argued.
The MP Social Communication Department was consulted if the Prosecutor’s Office in charge of the case would appeal the judge’s decision, but at the close of this note the question did not answer.
The judicial agency said that the judge enjoys judicial independence and regarding his resolutions, an opinion will not be issued considering that a request for prejudice can be known at some point.
