Xinabajul Huehue was surprised by the resolution of the National Arbitration Court (TAN)entity that declared with place the appeal presented by Deportivo Marquense to reintegrate the three points. As a result, the San Marcos team will remain in the National League.
Marquense was destined to return to the First Division League, But he decided to legally fight for the points that were withdrawn after the demand filed by Xinabajul Huehue, due to the alleged improper call of the Argentine Ramiro Rocca, who, however, had no participation in that meeting.
The Huehueteco representative fell into that game (3-0) and sought to recover the points arguing that Rocca could not act with three teams in the same season, after passing through Municipal, Alliance of El Salvador and Marquense.
Initially, the victory had been granted to the whole of the “X”, but the lions appealed the decision, and the dispute reached so. After several months, the court issued its final resolution, failing in favor of Marquense, returning the points and saving it from the descent.
Given this situation, the most harmed team was Xinabajul Huehue, who will become the second descended, next to Zacapa, that retired from the tournament before it started.
They will appeal to the TAS
The news was not well received by the Huehueteca institution, which immediately raised his voice. Through a statement, he announced that he will present an international appeal.
Xinabajul Huehue already prepares everything to go to the sports arbitration court (TAS), where he hopes to exhaust all civil and sports instances, hoping that FIFA statutes and regulations be respected and complied with, as he had previously stated.
“We inform our faithful hobby to the public opinion that we will immediately go to the Court of Sports Arbitration (TAS) so that this case is reviewed with international impartiality. Likewise, we will initiate the corresponding legal actions by civil via, in defense of our rights and respect for sport,” he says part of the statement.
The directive of the Huehueteco team was surprised by the ruling of TAN, claiming that resolutions based on the regulations and with documentary evidence that favored the representative of Huehuetenango had previously issued. He also stated that this new decision generates doubts and distrust of the transparency of institutional processes.
“It is unacceptably that suddenly established failures, which sows doubts, and generates distrust in the institutional processes of national football, ”says the official pronouncement.
The directive flatly rejected the resolution, ensuring that it doubts that it has been taken with full justice and transparency.
Appeal to the TAS may take weeks or months to resolvedepending on the burden of court cases and the complexity of the file. However, the simple fact of climbing the case to an international instance Open an important precedent For Guatemalan football.
