This Tuesday, May 5, in addition to knowing that there were no challenges in the integration of the list of candidates for attorney general, the nomination commission also learned of the request from the Anti-Corruption Prosecutor’s Office, who processed a complaint filed by the Foundation against Terrorism.
Commissioner Luis Aragón Solé read the official communication, which states that the aforementioned prosecutor’s office requires information on “the requirements to apply for the position of attorney general in the case of the current election and report the administrative procedure carried out by the 2026-2030 commission.”
The letter that the commissioners saw also indicates that it must be explained “the case that an applicant does not meet the established requirements to apply for the position of attorney general, and must inform each stage of the procedure, duly substantiated.” The commissioners must respond to the request within a period of no more than five days.
Aragón Solé, after reading the letter at the commission meeting, suggested that the report be sent justifying the requirements to be a prosecutor established in articles 251, 216 and 113 of the Constitution of the Republic, as well as in article 12 of the Law of Nomination Commissions.
The investigation by the Anti-Corruption Prosecutor’s Office responds to one of two complaints from the Anti-Terrorism Foundation. This entity suggested that there could be irregularities in the weighting of some applicants, an issue that the Prosecutor’s Office would be verifying with the required information.
No challenges
The commissioners at this Tuesday’s meeting confirmed that no challenges were presented to the list of six candidates and they agreed that the respective report will be sent to President Bernardo Arévalo, so they officially concluded the candidate election phase, Guatemala Visible reported.
The attorney general election process is part of the second-degree elections and the designation of the next head of the MP is in the hands of President Bernardo Arévalo, who has already interviewed the six candidates.
Claudia Paredes, president of the postulator, indicated that the process was developed with objectivity, transparency and integrity, as required by this type of event and in accordance with the principle of legality.
He thanked the commissioners for being guarantors of each of the stages.
He reiterated that in the process the parameters mandated by the Constitution, the Law of Nomination Commissions and the internal regulations that the commission approved were complied with. Paredes indicated that this was the last session, unless there were any events in accordance with the law.
The list is made up of lawyers Julio César Rivera Clavería, Néctor Guilebaldo de León, Beyla Estrada Barrientos, Gabriel Estuardo García Luna, Carlos Alberto García Alvarado and César Augusto Ávila Aparicio.
