This Thursday, May 21, journalist Jose Rubén Zamora Marroquín filed a criminal complaint against 10 people, including former president Alejandro Giammattei, former attorney general Consuelo Porras and former head of the FECI, Rafael Curruchiche, whom he accuses of having participated in alleged irregular actions related to the criminal proceedings brought against him.
The complaint was filed with the Public Ministry (MP) and is also directed against former officials, prosecutors, judges and individuals who, according to the document, would have intervened in decisions, proceedings and actions linked to the judicial cases opened against Zamora since 2022.
In the letter, Zamora affirms that there was a “selective use of institutional mechanisms” and an alleged coordination between officials and individuals to promote investigations, restrict means of defense and build incriminating hypotheses against him.
The journalist maintains that the reported events could constitute crimes such as abuse of authority, breach of duties, influence peddling, obstruction of criminal action and denial of justice, among others contemplated in the Penal Code.
Zamora also questions actions of the Special Prosecutor’s Office against Impunity (FECI) during the reception of an initial complaint filed in July 2022, as well as the absence of immediate corroboration proceedings on facts that, according to the document, could be verified through bank records, surveillance and other investigative tools.
In several sections, the complainant assures that there was a deliberate omission of evidence that, in his opinion, favored his defense, in addition to an alleged subsequent reconstruction of investigative hypotheses through documentation and materials incorporated into the files some time later.
The complaint also mentions that, after his capture and stay in preventive detention, new investigations and actions began against defense lawyers, journalists, family members and people linked to his professional and personal environment.
The document indicates that the accusations are preliminary in nature and that criminal responsibility must be determined during the corresponding investigations.
