The Constitutional Court (CC) provisionally suspended the payment of the MarbEx system in Antigua Guatemala, Sacatepéquez, after deciding to temporarily revoke articles 1 and 4 of the regulations that regulate payment for parking on public roads, judicial sources reported this Wednesday, May 20.
The resolution establishes the provisional suspension of two articles of the “Regulation of income for temporary private use of public roads for the parking of vehicles”, which was approved by the Municipal Council of Antigua Guatemala in the session documented in minute 104-2024, of September 2, 2024, and published in the Diario de Centro América on November 20 of the same year.
According to the ruling, article 4 of the regulations is suspended while the constitutional process continues. That section regulated the collection of the fee for parking in public spaces of the municipality.
The resolution indicates: “The provisional suspension of articles 1 and 4 of the ‘Regulation of income for temporary private use of public roads for vehicle parking’ is decreed, inserted in the third point of minute number 104-2024, which documents the session of the Municipal Council of Antigua Guatemala, department of Sacatepéquez, held on September 2, two thousand twenty-four and published in the Diario de Centro América on November 20 of the same year.”
With this decision, the MarbEx charge is temporarily suspended, so neighbors, workers and tourists will be able to park in permitted areas without making the payment established by the municipality.
The suspension also temporarily voids traffic fines related to non-payment of the system.
The tariff scheme established charges of Q10 for vehicles and Q5 for motorcycles from Monday to Thursday. On Fridays, weekends and high-traffic days, rates increased to Q20 for cars and Q10 for motorcycles.
Prensa Libre consulted the Municipality of Antigua Guatemala about the CC resolution and its position regarding the suspension of the system; However, they still do not respond.
