Action of unconstitutionality and challenge against the Court stops the extradition process of the Morales Guerra brothers

Ronald Alexys and Héctor Rubén, surnames Morales Guerra, this Friday, June 19, appeared before the Fifth Criminal Sentencing Court to resolve their situation regarding an extradition request against them to the United States.

By this Friday, the Court had to resolve the admissibility of the procedure, but defense lawyer Víctor Luna stated that he filed an unconstitutional action regarding the extradition request.

However, the judges indicated that said appeal did not stop the processing of the scheduled hearing.

The defense of the Morales Guerra brothers, upon learning of the Court’s decision, filed a challenge against the defendants for allegedly having some interest in the process and for doubting their impartiality, with the aim of removing them from the extradition process of those indicated.

After several minutes of deliberation, the judges accepted the challenge and indicated that it will be the First Chamber of the Court of Appeals that must decide whether the file continues to be heard in the Fifth Criminal Court or if the Third Criminal Court is designated.

This action suspended the extradition hearings of the brothers, who must wait for the legal resources to be revealed, in the meantime, they must remain in prison.

On April 29, Carlos Obeniel, another of the Morales Guerra brothers, agreed to be extradited to the United States.

The three were captured on February 20 in Dolores, Petén, when they were required by the United States District Court for the Eastern District of Texas, where they are accused of crimes related to drug trafficking, according to authorities.

According to authorities, the three were part of a structure dedicated to drug trafficking that operated from 2006 until May 2024.
