The Second Chamber of the Court of Appeals suspended the immobilization of a game for more than Q190 million which, according to the board of directors of the Santo Tomás de Castilla National Port Company (Empornac), put its operations at risk. The court also ordered the seizure of accounts, salaries and arrests of 19 company executives.
The resolution of the Third Criminal Court in favor of Luis Pedro Chang Figueroa, administrator and legal representative of the company Equipos de Puerto, SA, who claims a million-dollar debt for breach of a contract with the port company.
On May 22, Judge Julio Vásquez Xol admitted a complaint by Chang against the members of the Board of Directors and Empornac and ordered precautionary measures. In addition, he transferred the claim to the Public Ministry (MP) to carry out the corresponding investigations into Chang’s complaint.
In a resolution of June 24, the Chamber granted the provisional protection requested by the management of Empornac “given that the circumstances make it advisable” and based on article 28, literal d), of the Protection Law, it considers that “the claimed act violates article 134 of the Constitution.”
The provisional protection was notified to the Third Court to comply with the order and a period of 48 hours was enabled for all parties in the discussion, the appealed judge, the Public Ministry and the directors of Empornac to speak out.
The court that stopped the precautionary measures, which according to Empornac and sectors, risk the port operation, is made up of magistrates Selvin Flores, Edwin Zaldaña and Víctor Castillo.
