Judge María del Carmen Zamora accepted the request from Eduardo Masaya’s defense to review the coercive measures, with which she raised withdraw the ban on leaving the country and house arrest.
The hearing took place in the Seventh Criminal Sentencing Court.
Masaya’s lawyers argued that modifying the measures would allow the professional fulfill the duties assigned as a member of the Board of Directors of the College of Lawyers and Notaries of Guatemala (CANG), since some activities even take place outside the country.
The supporting plaintiff, Fernando Linares Beltranena, agreed with the defense’s request, with the condition that Masaya continues signing every 15 days at the Mixco Peace Court. In addition, he disagreed with the position of the Public Ministry (MP), which opposed the request.
He also emphasized that Masaya must remember that he has an open criminal process and that he committed to submit to the Court when notified.
He trial against Masaya will begin on December 8.
On March 31, the Second Court of Appeals rejected the appeal presented by the MP, with which he sought to revoke the house arrest so that he could return to prison.
On July 22, 2025, Judge López Zamora also ruledMasaya’s preventive detention was lifted and, at that time, he was granted unsupervised house arrest.
On May 26 of that year, Judge Fredy Orellana sent Masaya to trial for the possible commission of the crime of ideological falsehood on a continuous basis, within the Semilla Corruption case.
The Prosecutor’s Office argues that the accused, in his capacity as a notary, would have endorsed legalizations of minutes that were not signeddespite the fact that these would be part of the adhesion sheets for the registration of the pro-formation committee of the Semilla Movement party.
The capture of Masaya was carried out on January 28, 2025after an order issued by the Seventh Criminal Court of First Instance, led by Judge Fredy Orellana.
