The Constitutional Court declares with place the proper execution of the amparo promoted by the opposition deputies who promote an agenda to take power positions in Congress.

The Constitutional Court declared with place the request for due execution of the provisional amparo granted to a group of opposition deputies, who claimed the undue suspension of the tenth ordinary session of the Congress.

In that plenary, the opposition sought to choose the first secretariat of the Board of Directors of the Congress, as well as to make changes in the presidencies of the work commissions and in the representation before the Monetary Board.

In its resolution, the Court orders the President of Congress to “give effective compliance with the provisions” in the amparo; that summons the deputies with sufficient time in advance, so that the resumption of the tenth ordinary session can be continued, which must be carried out according to the session calendar, that is, on May 13.

In the session “it must be resumed at the point where the procedure was broken in the quorum verification, on April twenty -nine, two thousand and twenty -five; for this purpose, if the necessary quorum exists, it must continue with the motion that corresponded to know”, according to the Court.

The failed day

The Court granted the amparo and ordered the session to resume on Tuesday, May 6. This was convened and, although two groups of protesters blocked the accesses to Congress, the deputies managed to enter the Legislative Palace. The session passed between accusations for the marking of assistance of the deputies, Boicot attempts so that the operation of the electronic board would not be carried out and questions.

The deputies promoters of Amparo indicate that there were “inconveniences in their realization because different people were presented with an aggressive and intimidating attitude that blocked the entries to the Congress of the Republic of Guatemala and launched pyrotechnic fires (bombs and mortars), in order to intimidate the people who approach”.

Consequently, they point out that the president of the Congress did not make any decision or measure for the session to take place as ordered by the Court. “The deputies who could enter and who presented themselves to the parliamentary hemicycle were able to witness that the electronic board marked the presence of 83 deputies, which was not possible, since the entry of the congressmen was not yet allowed.”
