The Public Ministry (MP) confirmed the issuance of a circular addressed to all personnel of the institution, in which it prohibits the dissemination of institutional information, files, audios, images and procedural actions by unauthorized means, including social networks and messaging platforms.
“It is strictly prohibited to disclose, reproduce, transmit or disseminate institutional information, documents, images, audios, procedural actions, file data, internal communications or any other content linked to the exercise of sensitive institutional functions,” states the document dated May 18, 2026.
The circular establishes that prosecutors and workers may not use information related to investigations or institutional actions to favor political or personal interests.
“It is prohibited to use fiscal activity, procedural actions or any information derived from the exercise of institutional functions to make allusions, references or statements (…) that have the purpose or result of benefiting or harming political, partisan or personal interests,” it adds.
The MP also warned that these actions could affect “the objective, impartial and independent character” that should govern institutional action.
“Ethics are permanent,” says the new head of the MP
The provisions were issued two days after Gabriel García Luna took office as the new attorney general of the MP.
During an interview with Free pressGarcía Luna stated that ethics must be a permanent conduct among the members of the institution and not be limited only to work hours.
“Yes, it is interesting to see the behavior of some members of the Prosecutor’s Office – MP -, because a structural part is ethics. Just like the judiciary and the magistracy, the Prosecutor’s Office not only has to act objectively, but impartially,” he expressed on May 17.
He added that ethical behavior must also be kept outside of institutional functions.
“I am not a prosecutor only from 8 a.m. to 4 p.m., or when I am on duty, but it is permanent. And it is not because I am working all the time, but in my personal life I also have to behave in compliance with ethical values,” he stated.
García Luna recalled that the most recent reform to the Judicial Career Law strengthened disciplinary mechanisms and pointed out that the Tax Code of Ethics contemplates serious and very serious offenses linked to inappropriate conduct.
The attorney general also assured that the MP will maintain internal supervision, although he stated that this should not become an inquisitorial mechanism.
Restrictions on social networks
The new attorney general of the MP said there is a prohibition on making publications related to institutional work or ongoing litigation on social networks.
“One of the instructions is that there is a prohibition, without limiting the freedom to use social networks, of course, to make publications referring to the institution or the work carried out by all members of the MP,” he said.
In addition, he recommended preventing judicial discussions from being transferred to the digital sphere.
“Do not take the litigation to social networks. Yes, it is practically litigation and any type of information or message that has to do with the institution, because that violates ethical principles, at a minimum,” he emphasized.
