The magistrates of the First Chamber of the Court of Appeals declared inadmissible, this Monday, June 1, the challenge raised by lawyer Otto Marroquín against Judge Carol Yesenia Berganza, of the High Risk Court C, with which he sought to separate her from the Los Calavera case.

For the togados, the judge acted in accordance with the law on April 27, by requesting that lawyer Marroquín present a certificate from the National Institute of Forensic Sciences (Inacif) for health problems, since he presented an excuse for not attending the hearing scheduled for that day.

The magistrates ruled that the lawyer was unable to prove that the judge had acted outside the law.

In addition, they heard the arguments of Marroquín, who sought to have the judge removed from the case.

The lawyer argued that the judge did not accept a medical excuse presented and that she doubted that he was suffering from health problems, which made it impossible for him to appear at the hearing on April 27.

The Public Prosecutor’s Office (MP) and the other defense lawyers affirmed that the judge acted in accordance with the law and requested that the challenge presented by Marroquín be declared inadmissible.

The Calavera Case

According to the MP’s investigation, the crime against Francisco Alberto Galindo Chacón and Mario Fernando Meza Batres, general manager and doctor of a private hospital in zone 10 of the capital, respectively, He would have been executed by a criminal structure of hitmen called the Calaveras.
