A man identified by the Public Ministry (MP) as Elkar G. was sentenced to four years in prison after accepting charges of conspiracy to commit money laundering or other assets, the Anti-Money Laundering Prosecutor’s Office reported this Wednesday, May 6.

The sentence was handed down by the Pluripersonal First Instance Criminal Court for Extortion Crimes through the special procedure for accepting charges.

In addition to the prison sentence, the convicted person must pay Q4 thousand to Hospicio San José and Q4 thousand to the Patitas Arriba Association, as dignified reparation.

According to the investigation, initiated based on a complaint from the Special Verification Office of the Superintendency of Banks, Elkar G. carried out financial operations without economic or legal justification while serving as legal representative of Grupo Diseño y Arte SA

The prosecution established that the entity received million-dollar loans from cash deposits, third-party checks and fractional operations. It also detected multiple international transfers in US dollars without documentation supporting commercial activities, imports or exports.

The investigations determined a pattern of use of bank accounts to enter, mobilize and hide funds through fractional deposits, participation of third parties and transfers abroad.

The Public Ministry indicated that there was a distribution of functions to carry out acts of placement and stratification of money.

Likewise, the investigation revealed that the company did not register real economic activity with the Superintendence of Tax Administration, it lacked employer registration in the Guatemalan Social Security Institute and it did not have an operational physical headquarters.
