This Friday, June 19, the Constitutional Court (CC) granted provisional protection to the Municipality of Antigua Guatemala and ordered the authorities to refrain from allowing activities called by the Orgullo Antigua organization in areas and roads whose use was previously denied by the Council.
The resolution, issued within file 5464-2026, establishes that the authorities in charge of public security must not validate or facilitate concentrations, parades, marches, installation of platforms, pedestrian closures or any private use of spaces that were rejected by the Colonial City commune.
In the resolution, the CC indicated that, if the organizers decide to exercise their right to public demonstration, they must do so in places, routes and times other than those not authorized by the municipality.
In addition, the constitutional court ruled that any activity must take place on routes and times different from those of the La Merced Church procession and other family, cultural and religious activities previously authorized in the historic center of Antigua Guatemala.
According to the resolution, the measure seeks to avoid interference between activities, preserve public order, guarantee the safety of people and protect social peace.
The Court also ordered the authorities to adopt surveillance actions to guarantee both the rights of the parade participants and those who express opinions regarding the freedoms promoted during the activity.
Likewise, he instructed the authorities to ensure the protection of the spiritual and moral values of society, especially of children and adolescents, in accordance with constitutional provisions and the Law for the Comprehensive Protection of Children and Adolescents.
The resolution states that the competent institutions must ensure that minors are not exposed to information, expressions or materials incompatible with their state of childhood, in observance of the principle of the best interests of the child.
The Court also urged the organizers of the parade and the population in general to exercise their rights peacefully and within the limits established by the legal system.
In addition, it ordered the Attorney General’s Office (PGN) to adopt protection measures in favor of children and adolescents, and the Human Rights Attorney to supervise compliance with the dictated provisions.
