The Constitutional Court (CC) a complaint event took place Ministry of National Defense and annulled the resolution that kept the construction of the maximum security prison El Triunfo, in Morales, Izabalwith which the Government will be able to resume the project.
He defense minister, Henry Saenz, explained that the resolution allows the physical phase of the work to begin, while other judicial procedures related to the administrative file continue.
“Now the Constitutional Court is already protecting us that we can build,” he stated.
Sáenz indicated that, while the legal actions were being resolved, the Ministry advanced in the administrative processes necessary to execute the project, including the qualification of participating companies and the preparation of technical specifications.
He specified that construction could begin between second and third week of July with the movement of earth and the formation of embankments, prior to the construction phase.
The official added that the schedule prepared by the Army Corps of Engineers contemplate a 12 month period from the beginning of the work until the delivery of the facilities to the Ministry of the Interiorso the prison could end towards July 2027, if no new interruptions arise.
Legal process advances
Sáenz pointed out that the CC’s resolution corresponds to the first protection promoted against the project and affirmed that, until now, the State has obtained favorable resolutions in four legal actions related to construction.
Among them he mentioned resources promoted by a group of lawyers, community members, community leaders and actions derived from a municipal affairs judge.
The minister maintained that the project is being developed on an extinct property in favor of the State and reiterated that the Government will continue with the work considering that it meets the legal requirements.
With this last resolution, the CC makes the amparo pending resolution, since for reasons of hierarchy and jurisdiction, it was ordered that it pass from the Izabal Chamber to the Supreme Court of Justice within a period of five days.
