This Wednesday, May 20, lawyer Eduardo Masaya presented an administrative and a criminal complaint against the prosecutors of the Public Ministry (MP) Rafael Curruchiche and Leonor Morales.

Masaya, in statements to the press in front of the MP headquarters in zone 1, explained why he filed complaints against the aforementioned officials.

He added that the complaint is due to the functional participation that both have had in the criminal prosecution against them and that “they have committed a series of illegalities throughout the process.”

In the case of Curruchiche, the complainant recalled that, at the time of his capture during the electoral process of the College of Lawyers and Notaries of Guatemala, the prosecutor “publicly made statements of support for one of the lists” and, at the same time, carried out functional actions in the criminal process.

In addition, he appeared at hearings, so, according to Masaya, there was an obvious conflict of interest, which, according to the Organic Law of the Public Ministry, constitutes “a very serious offense” for having carried out actions of a political nature during his work as prosecutor.

The complainant explained that, in the case of Prosecutor Morales, he filed the complaint because, despite having been a procedural part of the case, he has been denied access to certain parts of the file and has been denied relevant and useful procedures for the investigation.

The criminal complaint was filed for the alleged crimes of abuse of authority and breach of duties.

In which case Masaya is indicated

According to the MP, Eduardo Masaya, in his capacity as notary, would have endorsed legalizations of minutes that were not signed, despite the fact that these would be part of the adhesion sheets for the registration of the pro-formation committee of the Semilla Movement party.

On January 28, 2025, Eduardo Masaya was captured. On that occasion, the Prosecutor’s Office indicated: “Tonight the arrest warrant issued by the Seventh Pluripersonal Court of Criminal Instance against Eduardo Gabriel Masaya Juárez for the crime of ideological falsehood became effective.”

Currently, he is waiting for the debate against him to begin. He is repeatedly accused of ideological falsehood in the Semilla Corruption case.

The trial is scheduled for December 8, 2026 in the Seventh Sentencing Court.
