Until May 1, the Constitutional Court (CC) accumulates around 12 amparos that have not yet been resolved and that have been filed as a consequence of the appointment of the new attorney general and head of the Public Ministry (MP).
On May 17, President Bernardo Arévalo will carry out the election of the new head of the investigative entity. During this week, the president held interviews with the six candidates who are part of the new list, which was formed by the Nomination Commission as a consequence of an order issued by the Constitutional Court, which resolved a legal action filed against the previous list, which had been formed by the commission.
Likewise, the Nomination Commission to elect the attorney general will conclude its functions next Monday, May 4, since that same day the deadline for submitting challenges to the new list issued by the qualifying body ends.
Nevertheless, The new list is not yet exempt from legal action, since a new protection was presented on April 25 aimed at canceling the payroll. Said legal action was presented by David Alberto Juárez Aldana, who seeks to have a new qualification made by the applicant and to subtract points from prosecutors and public defenders, under the same principle that subtracted the experience of the judges in the scoring before the Nomination Commission.
This legal action is one of those that are still pending to be resolved by the constitutional court.
President is about to make an appointment
President Bernardo Arévalo interviewed the six candidates to occupy the position of attorney general during this week. The order of the interviews carried out by the president was established according to the score that each of the candidates obtained at the time of being qualified by the Nomination Commission.
The interviews took place from Tuesday, April 28 to Thursday, April 30. On the first day, the president interviewed professionals Gabriel Estuardo García Luna and Beyla Adaly Estrada Barrientos. On Wednesday the 29th, Carlos Alberto García Alvarado and César Augusto Ávila Aparicio were interviewed. While on Thursday the 30th he interviewed Julio César Rivera Clavería and Néctor Guilebaldo de León Ramírez.
According to the president, the central axis of the interviews revolved around the “co-option” of the Public Ministry by political-criminal networks that have affected the work of the investigative entity.
In recent days, some sources close to the appointment process, They have indicated that there is a possibility that President Arévalo will appoint Gabriel Estuardo García Luna to the position.
During the press conference held on Monday, April 27 at the National Palace of Culture, The president was approached about this possibility, which he neither ruled out nor affirmed, and only indicated:
“As for the attorney general, the process involves a series of meetings and, obviously, the announcement will be made at the end of the meetings, not before.”
After the interviews carried out, the president will carry out the analysis of the files of the six candidates. According to the General Secretariat of the Presidency, the appointment of the new attorney general will be made by the president during the week prior to May 17, the date on which the new attorney general must take office for the period 2026-2030.
